Terms and Conditions

CAREFULLY READ THE FOLLOWING TERMS OF SERVICE, WHICH GOVERN YOUR ACCESS AND USE OF THE GET HOOPTIE PLATFORM. THESE TERMS INCLUDE IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS AS WELL AS CERTAIN EXCLUSIONS AND LIMITATIONS.

(“Get Hooptie”) provides an online platform under the brand name “Get Hooptie,” which connects drivers who have empty seats in their vehicle and will be making a trip with passengers who are seeking to make the same trip and are in need of transportation. The platform is available through our website and any other subdomains or mobile applications that Get Hooptie makes available. By using the platform, you understand and agree to be legally bound by these terms of service, whether you register to use the platform or not. These terms govern your access and use of the platform, as well as all members’ and Get Hooptie content.

If you do not agree with the terms of service, you do not have the right to continue using or accessing the platform and all members’ and Get Hooptie content. Failure to abide by the terms of service may result in civil and criminal penalties. The platform is offered as an online platform through which drivers and passengers can post and arrange trips for carpooling purposes directly with each other and in a strictly non-commercial or professional context. By using the platform, you confirm that you acknowledge that Get Hooptie is not a party to any agreements entered into between drivers and passengers, and has no control over the conduct of drivers, passengers, or members of the service. You understand that Get Hooptie is not an insurer, agent, or broker, and you disclaim Get Hooptie of all liability in this regard to the maximum extent permitted by law.

1. COMMON DEFINITIONS

A “Member” is a registered user of the service, either a driver or a passenger or both.
A “Driver” is a person using the service and offering spare seats in their vehicle to share with other passengers.
A “Passenger” is a person using the service and booking seats in a driver’s vehicle.
An “Account” is created by a member to access the service.
A “Trip” is a journey between an origin and a destination at a given date and time and includes details such as a pick-up point, drop-off point, space for personal items and the number of seats available. A trip is created and maintained by a driver.
A “Booking” refers to the act of paying a contribution for a trip through the service before the trip happens.
A “Request” is posted by a passenger looking for a trip between an origin and a destination on a particular date.
A “Contribution” or “Trip contribution” refers to a sum of money agreed and paid by the passenger to the driver to cover the costs of a particular trip and can’t accrue profit for the driver.
A “Booking fee” is a service fee added on top of a contribution and paid by the passenger when booking on a trip.
A “Payment” refers to the total amount of money paid by a passenger when booking on a trip (contribution + booking fee).
A “Payout” refers to the contributions accrued from bookings on a trip and sent back to the driver using their preferred payout method.
A “Payout fee” is a service fee deducted from a driver’s payout from the contributions they receive from passengers on a trip.
A “Payout method” refers to the method used to send a payout to a driver, either direct deposit or PayPal.
The “Cancellation allowance” is the ability for drivers to cancel a maximum of one trip with approved passengers or one approved booking every six months.
“Taking a ride”, “Carpool” or “Carpooling” refer to the act of sharing a ride with other passengers for the purpose of saving money and reducing traffic congestion.
Please note that the terms of service are subject to change at any time without prior notice.

2. CHANGES TO THE TERMS OF SERVICE

Get Hooptie reserves the right to modify the Service or these terms of service, including the Booking fee, at any time and without prior notice. Notification of any changes will be posted on the Service or provided through other means. If the modified terms are not acceptable, the only recourse is to stop using the Service.

3. YOUR RESPONSIBILITIES

Members are required to verify their identity through their email or phone number. Get Hooptie does not investigate any Member’s reputation, conduct, morality, criminal background or any other information posted on the Service. It is the responsibility of the member to use their judgement and determine the suitability of other members of the Service. Direct communication with potential Drivers or Passengers through the Service is encouraged and the same precautions should be taken as when meeting a person for the first time.
Members are solely responsible for their interactions with other members of our Service. Get Hooptie will not be held responsible for any damage or harm resulting from interactions with other members. The company reserves the right to monitor interactions and restrict access to any member posting material that is deemed objectionable.
In the event of a dispute between members, except when such exclusions are forbidden by law, members release Get Hooptie (and its affiliates) from any claims, demands and damages (actual or consequential) of any kind and nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

4. YOUR CONDUCT

As a member of this service, it is expected that you will act in a responsible and reasonable manner. This includes, but is not limited to:
Operating your vehicle safely, following traffic laws, not driving under the influence, and ensuring that your vehicle is in good working condition and has passed any necessary inspections.
Not violating any third party’s rights, including but not limited to intellectual property, privacy, publicity, or contractual rights.
Not using any information obtained through this service for any unauthorized purpose.
Not disrupting or damaging the service in any way.
Not using this service to distribute spam.
Treating other members with respect and not engaging in any form of harassment, abuse, or stalking.
Not using this service for commercial activities unless explicitly agreed upon with Get Hooptie.
Not registering on behalf of another individual.
Being at least 18 years old and having the legal capacity and authority to enter into a contract. By using this service, you represent and warrant that you meet these requirements.
Not assisting any third party in violating any of the above rules.

Reporting misconduct
If any member of the service behaves in an inappropriate manner, including but not limited to offensive, violent or sexually inappropriate behavior, or engages in other disturbing conduct, it is vital that you report such person to the appropriate authorities and to us immediately by contacting us. It is important to note that your report does not obligate us to take any action or cause us to incur any liability.

5. USE AND ACCESS OF THE SERVICE

It is important to note that no commercial activities are allowed, unless otherwise agreed upon by contract with Get Hooptie.
The service is intended solely for the purpose of providing carpooling for drivers and passengers in a private capacity and may not be used for profit or in any commercial or professional context, unless otherwise agreed upon by contract with Get Hooptie.
Drivers are not permitted to profit from any carpooling trip, and the cost contribution should only be used to cover the driver’s expenses and may not be used to generate profit. Additional services such as package delivery, waiting time, additional drop-off and pick-up points and collecting additional passengers may not be offered or accepted for profit or gain.

All carpooling trips and pick-up and drop-off points must be pre-agreed through the service in advance, and drivers may not collect passengers from any location that has not been pre-agreed through the service.
Additionally, drivers are not allowed to post speculative trips and should only post trips if they are certain of their travel plans to ensure reliability for passengers.
It is important for drivers to be aware that using the service in a commercial or professional manner may void their insurance coverage. Get Hooptie’s liability is limited as outlined in these terms of service, and Get Hooptie will not be held responsible for any breaches of agreements between members or violations of these terms of service, particularly in instances where a driver offers services through the service in a professional or commercial capacity, which may invalidate their insurance. It is the responsibility of members to ensure that services are not being provided on a commercial basis.
Get Hooptie is not a transportation service provider. Instead, it is an online platform that allows members to connect and arrange carpooling with one another. Get Hooptie does not interfere with the details of the trips, destinations or timings and the agreement for carpooling is made between the driver and passenger. Get Hooptie is not a party to any agreements or transactions between members, and is not responsible for any issues arising from bookings between members. Get Hooptie does not act as an agent for any member.
Failure to comply with these terms of service will result in the immediate suspension of a member’s account and the restriction of access to further services.
Access to the Carpool service
Each member of Get Hooptie is required to create an account to access the service. In order to create an account, members must:
Create an account by either logging in or registering to the service.
To register, use your email and password and fill out all necessary fields on the registration form. Ensure that the email address provided is verified and accessible while using the service. Verify your phone number and have the ability to communicate with other members through calls and text messages while utilizing the service. Also, provide your legal first and last name, a clear profile photo of yourself that shows your face, an accurate description of yourself, your age and gender, and accept our terms of service and privacy policy.
When creating your account, you agree to provide accurate and true information and to update it through your profile or by notifying Get Hooptie.
You agree to be the sole owner of your account and not to share its access with anyone.
You agree that all communications, bookings, payments, and the use of any other features provided by the service are made solely by you and not by a third party or on behalf of a third party.
You agree not to create or use any accounts other than the one initially created by you, under your own identity or that of a third party.
You may be required to enter an email and password as part of the registration process. You are solely responsible for keeping these confidential and must notify us immediately of any unauthorized use of your login details or any other security breaches.
Eligibility to use the Service
Get Hooptie provides a carpool service that enables members to connect and arrange carpooling with one another. The passenger is expected to reach out to the driver through the service to coordinate the carpool and any conditions of travel, including the size of luggage and equipment.
The ability to use the carpool service is at the discretion of Get Hooptie, and we reserve the right to withdraw this service from any member at any time.
Conditions for providing the Service
Get Hooptie reserves the right to:
(i) Discontinue the service and limit it to certain members and/or destinations.
(ii) Make exceptions to the service’s policies.

6. FEATURES OF THE SERVICE

Trips
The driver posts trip details on the platform by providing the starting point, destination, departure date and time, available seats, and any other necessary information. The driver proposing the trip must be the primary driver and cannot delegate the driving to another driver. If another driver is going to participate in the trip, this must be revealed and agreed upon by the passengers before departure. During the trip, passengers can communicate and make reservations with the driver through the messaging service and bookings feature provided by the platform.
Messages
Get Hooptie offers a messaging system to facilitate communication between members. The messaging service enables the driver and the passenger to discuss details of the trip. It is important to note that exchanging personal contact information such as phone numbers, email addresses, or website URLs is not allowed through the messaging service until the booking has been approved.
Bookings
The Passenger may only reserve one or more seats from the Service by making an online payment from a valid debit or credit card. Get Hooptie receives the Payment, which establishes a Booking for the Trip.
After making a successful Booking on a Trip, the Driver and Passenger are bound by the Booking, and any cancellations are subject to the Cancellations rules outlined below.
The Booking is communicated to the Driver and Passenger via alerts delivered to their registered email address or phone number with Get Hooptie. The Booking is only valid under the registered name of the Member on the Service and is void with any other name. When a Passenger places a Booking, the Driver is obligated to finish the Trip as agreed by both parties. The Driver must guarantee that their vehicle has enough seats to adequately fit each and every Passenger wearing a seatbelt.
Drivers can choose between two strategies for receiving Bookings for their trip:
Request to book
When a Driver uses the Request to book system, they can choose to personally accept or reject each Booking request for their Trip.
Passengers request a trip with a driver by authorizing payment on their credit card. Passengers can optionally set an expiry time for the Booking request between 1 and 24 hours, during which the Driver must manually accept or deny the Booking request.
If the Driver confirms the Booking request, the Booking is confirmed, the Passenger’s Payment is collected, and a charge is issued to the Passenger’s card.
If the Driver denies the Booking request, the Booking is null and void, and the Passenger’s Payment is not collected, and the authorization from the Passenger’s card is released.
If the Driver does not approve or deny the Booking request, the Booking request will expire after the Booking request expiration period has passed and the Passenger’s Payment will not be collected.
If the Driver has not already authorized the Booking request, the Passenger may withdraw it at no cost. The Passenger’s Payment is not collected, and the permission from the Passenger’s card is released.
Instant book
The Driver specifies that they want Bookings for their Trip to be promptly and automatically accepted without user involvement using the Instant book system.
Passengers who book instantaneously will make a booking with an immediate payment on their card and will be charged and authorized immediately.
Reservations made using the Instant book method.
Currency
All payments and payouts made through the Service are made in US dollars (currency symbol $USD).
Payments by Passengers
Online Payments – NO cash
Get Hooptie provides a Service with online Payments in order to give a dependable and successful Carpool experience. All Payments within the scope of this Facility must be processed online using Get Hooptie’s secure Payment service.
Other types of online or offline payments, such as cash and e-transfers, are not permitted and may result in the cancellation of your Account.
Booking fee
Get Hooptie charges a service fee on each Booking in the context of the Carpool service with Bookings (the “Booking fee”). The Passenger pays the Booking charge in addition to the Trip contribution at the time of booking.
Fraud and Identity
Members undertake to comply with any request from Get Hooptie, the bank, or any legal entity relating to preventing or combating fraud and/or money laundering. Members, in particular, undertake to cooperate with such Requests by providing proper identity papers. Members agree in advance to authorize Get Hooptie to freeze any monies owing to them in respect to any Trips or Bookings on the Service or to restrict their use to the Service in the case of an instant response to such Requests.
Payouts to Drivers
Payout methods
Bank account payouts are the sole Payout option offered by Get Hooptie to send Payouts to Drivers: Into their Bank account by inputting their Bank account credentials into their Account. Payouts from bank accounts may only be made to __________ Bank accounts in $USD. Get Hooptie is not responsible for ensuring that bank account data are accurately submitted, and any payouts issued to incorrect bank accounts cannot be reversed. Bank accounts may demand extra verifications for security and fraud prevention, such as the verification of a piece of identity from the Driver.
Driver cancellation policy
A Driver may cancel a Trip at any moment if there are no approved Passengers. The “Cancellation allowance” allows a Driver to cancel a maximum of one Trip with authorized Booking(s) or one approved Booking in a six-month period. If a second cancellation happens within six months of the first cancellation, the Driver’s Account will be reviewed and may be banned. The following rules apply when a Driver cancels a Trip (with authorized Booking(s)) or an accepted Booking:
The Passenger(s) are reimbursed in full, including the Trip Contribution and the Booking Fee.
On their profile, the Driver receives a cancellation auto-review.
The Get Hooptie team is contacted to determine whether the Driver was at fault and whether the cancellation counts toward their Cancellation limit.
If the Driver is found to be at fault, the cancellation is deducted from the Driver’s Cancellation allowance.
If the Driver is not found to be at fault, the cancellation is not deducted from their Cancellation allowance.
Get Hooptie retains the right to deactivate a Driver’s Account at any moment if there is cause to suspect they are causing an unpleasant experience for other Members.
Driver no-show policy
A Driver failing to appear on a Trip with permitted Passengers is significant and may result in account cancellation. When a Driver receives a no-show from a Passenger during the course of a Trip, an issue is lodged with the Get Hooptie team to gather further information:
If the no-show cannot be validated or was left by mistake, it is denied and the Driver incurs no penalty.
If the no-show is validated and the Driver is not to blame, a no-show review is posted to the Driver’s profile, and the Driver’s Account is maintained open.
If the no-show is confirmed to be the Driver’s fault, a no-show review is posted to the Driver’s profile, and the Driver’s Account may be blocked by our staff.
Get Hooptie retains the right to suspend a Driver’s Account at any moment if there is cause to suspect they are causing an unpleasant experience for other Members.
Passenger cancellation policy
If a Passenger cancels a Booking more than 24 hours before the Trip’s scheduled departure time, the Passenger receives a refund for the entire amount of the Trip Contribution, while Get Hooptie retains the Booking cost as a Cancellation fee.
If the Passenger cancels less than 24 hours before the Trip’s scheduled departure time, the Driver receives 50% of the Contribution amount, the Passenger receives a 50% refund, and Get Hooptie retains the Booking charge.
If the Passenger cancels after the Trip’s scheduled departure time or fails to arrive within 10 minutes of the Trip’s scheduled departure time, the Driver receives 100% of the Contribution amount, while Get Hooptie retains the Booking charge. The Passenger receives no reimbursement. In the case of a cancellation, the seats vacated by the Passenger on the Trip are made available to other Members of the Service and are subject to the Booking and Cancellations regulations outlined in this document.
If a Driver cancels a Trip after a Passenger cancels a Booking, the Passenger receives a full refund, including the Booking charge.
Under Request to book:
A Passenger may cancel a Booking request before it is authorized at no cost.
The Passenger is not charged if the Booking request expires.
The Booking fee is not levied in either circumstance, and a full refund is granted.
To guarantee fairness in specific situations, Get Hooptie reserves the right to offer refunds to Passengers outside of the Passenger cancellation policy, such as (but not limited to):
when a reservation is booked using a fraudulent payment method
when the Driver is providing an unlicensed business service
when a passenger makes a booking error and demands a refund within an acceptable time frame
when a Driver confirms a Booking request without first discussing trip specifics with the Passenger
A Passenger’s Account may be canceled if they cancel Bookings on many occasions.
Passenger No-show Policy
If a Passenger is scheduled to travel on a Trip but fails to appear, our Passenger no-show policy applies.
Get Hooptie retains the Booking fee while the Driver earns 100% of the Passenger Payment.
The Passenger’s profile is updated with a no-show review.
Get Hooptie retains the right to block a Passenger’s Account at any moment if there is cause to suspect they are causing an unpleasant experience for other Members.
Disputing Cancellations, Bookings or Payments
A Driver or Passenger has four (4) days following the departure of a Trip on the Service to dispute a Booking, Cancellation, or Payment that would result in the Driver getting a Payout. After four (4) days after the planned departure time on the Service, if neither the Driver nor the Passenger has disputed any Bookings, Cancellations, or Payments on that Trip that resulted in Contributions for the Driver, or if the Passenger has acknowledged the Trip has successfully occurred through the Service or through any other communication channels, including our Support channels or any other online or offline contact means, inside or outside the EEA, then the Driver will receive the Contributions.
A Driver or Passenger may submit a disagreement for a Booking utilizing the Service’s review system during the four (4) day dispute window.
We shall not execute a refund to the Passenger or the Driver after the four (4) day dispute window has passed after a Trip was scheduled to depart on the Service.
Insurance
It is the responsibility of the driver to ensure their vehicle is properly insured according to applicable laws and to confirm the validity of their insurance before each trip. The driver must also possess a valid driver’s license. Both the driver and passenger are required to check with their insurance company to confirm coverage while carpooling. Additionally, drivers with company-provided vehicles must confirm that their insurance policies cover all passengers on a carpooling trip. Both parties are made aware that insurance companies may refuse to cover damages that occur while using a private vehicle for commercial purposes. The member assumes full financial responsibility for any uncovered insurance claims resulting from an accident and acknowledges that Get Hooptie is not liable. Get Hooptie reserves the right to suspend a member’s account and withhold payments if they suspect or confirm any commercial activity related to the service, and to report any illegal activity to the proper authorities.
Litigations & conflicts
Get Hooptie tries its best to respond to all requests in a timely way, but it is under no responsibility to resolve all disagreements that happen between Members on the Service.
If a dispute between the Driver and the Passenger cannot be resolved, Get Hooptie has the right to withhold any outstanding money paid by the Passenger until an agreed solution is reached between the Passenger and the Driver or a legal decision is enforced.
ID verification
The Service provides ID verification. We have the right, at any time, to extend or restrict the availability of our verification or to stop the verification program.

Security

Get Hooptie is highly concerned about the security of your information. We encrypt sensitive information (such as a digital copy of your identification documents: ID card, driver’s license, passport, or any other form of ID) that you provide on our ID verification form. To secure the personal information supplied to us, we adhere to generally established industry standards both during transmission and once we receive it. However, no form of Internet transmission or computer storage is completely safe. As a result, we cannot guarantee its complete security.
In accordance with relevant laws, we shall make any legally necessary disclosures of any breach of the confidentiality, security, or integrity of your personal data held on our Service.
Your responsibilities
We request that Members authenticate their identification by linking:
their email address to the Service; and
their mobile phone number to the Service.
submitting a valid form of identification to the Service
Personal Driver’s License with a valid expiration date or a current abstract from the local governing transport authority are the only acceptable forms of identification for Drivers.
Personal Driver’s License with a valid expiration date, a current Driver’s License abstract, a national identity document, or a passport are the only acceptable forms of identification for Passengers.
We do not look into any Member’s reputation, behaviour, morals, criminal history, or any other information. When judging the appropriateness of other Members of the Service, you must use common sense. Be wise and cautious.
Privacy
Get Hooptie will not sell, disclose, or rent any information gathered during the ID verification process to third parties.
The files acquired as part of the Service’s ID verification procedure will be used to manually verify the accuracy of the information given. We shall destroy any documents you may have uploaded to our system (picture or scan of passport, ID card, or driver’s license) within 7 days following ID verification. The papers may be kept in backup files for up to 30 days before being permanently deleted. In compliance with Canadian law and our Privacy Policy, we do not maintain any further copies of your personal data anywhere.
The information included in the collected files will not be converted to text or kept in our database. We just utilize the procedure to visually verify IDs and do not keep any of the information included in the papers on our systems or in our database.
Nature of relationship
You acknowledge and agree that it is a fundamental term and condition precedent of your participation in the Referral program that you are not an employee, intermediary, or agent of the Company, and that you will not represent yourself as, or give anyone reason to believe that you are, an employee, intermediary, or agent of the Company. You accept that your involvement will not be interpreted as creating an employment or agency relationship between Get Hooptie and you. As a result, you have never been and will never be entitled to any of the benefits offered by the Company to its employees, including perks, salary, stock or stock options, incentives, profit sharing, vacation days, insurance, or medical and health benefits, and you hereby irrevocably waive any right or claim to them. None of your personal or professional responsibility will be covered by the Company.
Indemnity
You agree to defend, indemnify, and hold Get Hooptie harmless to the fullest extent permissible under applicable law from and against any and all claims, damages, liabilities, losses, expenses, and costs (such as reasonable charges and fees of lawyers and other consultants) arising out of or resulting from your negligence or intentional misconduct in connection with the Referral program.
Termination
Get Hooptie has the right to discontinue your engagement in the Referral program at any time and for any reason. The parties’ rights and obligations imposed by these Terms will survive the termination or expiration of this Agreement.
Exclusion and Limitation of Liability
Get Hooptie shall not be responsible for any particular, incidental, punitive, exemplary, or consequential damages of any kind arising out of or in the context of this Agreement, even if the Company has been advised of the potential of such damages in advance.
Modification
Get Hooptie has the right to change the Referral program at any moment by making an update on this website. You acknowledge that the Terms are acceptable to you and bind you by continuing to utilize the Referral program. If you do not agree with the updated Terms, your sole option is to stop utilizing the Referral program and withdraw from the Program.

7. COMMUNITY AGREEMENT

By accepting these Terms of Service, you also accept our Community Agreement, which provides a high-level description of how we expect Members to utilize our Service. For additional details, please see our Community Agreement page.

8. ANTI-DISCRIMINATION AND ANTI-HARASSMENT POLICIES

Anti-Discrimination Policy
Get Hooptie is a “community of equal opportunity.” Get Hooptie will not tolerate prejudice within its community and will work to prevent discrimination on the basis of color, creed, national origin, race or gender to the best of its ability. Discrimination allegations on Get Hooptie may result in the temporary or permanent cancellation of a Member’s Account.
Anti-Harrassment Policy
Get Hooptie is committed to delivering a harassment-free environment in all aspects. Harassment will not be accepted based on a Member’s gender, race, ethnicity, national origin, age, religion, or any other legally protected feature. This policy is anticipated and required of all Members. No Member’s usage of this Service will be harmed as a result of filing a complaint of illegal harassment against another Member. Harassment allegations on Get Hooptie may result in the temporary or permanent cancellation of a Member’s Account.

9. ANTI SEXUAL HARRASSMENT POLICY

Sexual harassment is defined as sexual activity that is unwanted and offensive to the person or people targeted. Harassment can take many forms, such as making inappropriate physical contact, using sexually explicit words, making sexual advances, making sexual jokes or comments, making obscene gestures, or displaying pornographic or sexually explicit images. The use of the Get Hooptie platform for the purpose of watching, exhibiting, or transmitting sexually explicit material may also be considered harassing behavior. Sexual harrassment allegations on Get Hooptie may result in the temporary or permanent cancellation of a Member’s Account.

10. REPORTING

If a Member believes they have been harassed because of their gender, color, national origin, religious beliefs, or any other legally protected trait, they should contact us immediately. Once the incident has been reported, it will be thoroughly examined, and any required remedial action will be done. All accusations of illegal harassment will be addressed in the most discrete and private manner feasible given the circumstances.

11. Third-Party Content

You may be directed to content from other Members or third parties (“Third-Party Content”) while using our Service, either directly or through connections to third-party Websites. Third-Party Content is not under our control and is not our responsibility. All risks connected with Third-Party Content must be assessed and borne by you.

12. LIABILITY, WARRANTIES, INDEMNITY, INTELLECTUAL PROPERTY AND OTHER LEGAL MATTERS

Limits of liability
Unless the following disclaimers are prohibited by law, if you are a resident of ______________, we will not be responsible for any damages of any kind (including, but not limited to, indirect, direct, incidental, special, general, consequential, exemplary, or punitive damages), even if we have been warned of the potential of such damages, arising out of or in connection with a) the Member’s use of or inability to use our Service or b) the cost of procuring any e) any other issue arising out of, pertaining to, or associated with our services or these conditions, including, but not limited to, bodily harm, mental distress, death, or any other damages resulting from conversation or meeting with other registered Members or individuals introduced to you via registered Members, whether online or offline.
