These Car Maintenance Terms for Hosts on the Get Hooptie Website (the “Terms”) are entered into by and between the host (the “Host”) and Get Hooptie, a carpool service provider (the “Company”).
Maintenance Responsibility
The Host acknowledges and agrees that it is their responsibility to maintain the car for optimum performance. The Host further acknowledges and agrees that they have and will perform regularly scheduled maintenance and ensure that the car has passed all safety, emission, and inspection requirements per state standards.
Maintenance Documentation
The Company does not keep track or gather any maintenance documentation from the Host. The Host is solely responsible for maintaining the car and providing any documentation as necessary.
Liability and Accountability
The Host acknowledges and agrees that they are solely responsible and accountable for any and all damages that result from the lack of maintenance or negligence on their part. The Company shall not be responsible or liable for any damages resulting from the Host’s failure to maintain the car properly.
Indemnification
The Host agrees to indemnify and hold the Company harmless from any and all claims, damages, liabilities, and expenses arising from their failure to properly maintain the car.
Termination
The Company may terminate the Host’s account and access to the Get Hooptie website if the Host fails to maintain the car properly or violates any other terms and conditions of the website.
Changes to Terms
The Company may modify these Terms at any time without prior notice to the Host. It is the Host’s responsibility to review these Terms periodically for any updates or changes.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in which the Host resides.
Entire Agreement
These Terms constitute the entire agreement between the Host and the Company and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written, between the parties with respect to the subject matter hereof.
By accessing or using the Get Hooptie website, the Host acknowledges and agrees to these Car Maintenance Terms for Hosts on the Get Hooptie Website.
